When the matter is taken up, with the consent of the learned counsel for the petitioner as well as the learned counsel for the first respondent, this petition is being disposed of by recording the nominations made by the respective parties.

2. Dr.A.Thiyagarajan, learned Senior Counsel for Mr.D.Senthil Kumar, learned counsel for the petitioner relying upon the affidavit filed by the petitioner, requested this Court to appoint Mr.M.Gnanasekaran as nominee on their side to be appointed as Co-Arbitrator.

3. Mr.D.Ravichander, learned Special Government Pleader appearing on behalf of the first respondent would submit that they would opt Hon'ble Mr.Justice K.Ravichandra Babu, Former Judge, Madras High Court, as their nominee to be appointed as Co-Arbitrator.

4. The respective counsels appearing on behalf of the petitioner and the first respondent would request this Court to appoint a Presiding Officer. Considering their consented request, this Court hereby appoints Hon'ble Mr.Justice D.Murugaesan, Former Chief Justice of Delhi, residing at No.11A, M.D.Sitaraman Avenue, 7th Cross Street, Injambakkam, Page No. 1 of 3

Chennai - 600 020 as Presiding Officer to the arbitral proceedings.

5. Mr.T.Paranthaman, learned counsel appearing for the third and fourth respondents/ Co-Arbitrators would submit that a part of fees that has to be paid on behalf of the first respondent is yet to be received by them.

6. The learned counsel for the first respondent undertakes to disburse the said fees within a period of four weeks.

7. The learned Arbitrators and the Presiding Officer are entitled to fix his fees as per the schedule to the Arbitration and Conciliation Act,1996. This Court further requests the learned Arbitrators and the Presiding Officer to endeavour to decide the dispute as expeditiously as possible.
