This petition is filed under Article 226 of the Constitution of India praying to issue a writ of Mandamus directing the 2nd respondent to cancel the Joint Patta bearing No. 349 issued on 16.02.2015 in the name of the petitioner and 3rd respondent.

ORDER

The petitioner made a representation dated 09.10.2015 to the respondent Nos. 1 and 2 seeking cancellation of Patta with respect to land comprised in Survey No. 200/3 of an extent of 1.12 1/2 cents. It is the case of the petitioner that he purchased the said property under a registered sale deed and in respect of the said property, mutation had taken place without hearing him.

2. Heard the learned counsel appearing for the petitioner and learned Additional Government Pleader for the respondents.

3. Though the petitioner has sought for a prayer to cancel the Joint Patta bearing No. 349, dated 16.02.2015, the question of cancellation will have to be considered by respondent No. 2. Considering the above, a direction is hereby issued to the respondent No. 2 to consider and pass appropriate orders on the representation of the petitioner dated 09.10.2015, within a period of eight weeks from the date of receipt of the copy of this order, after affording an opportunity of hearing to the petitioner as well as the 3rd and 4th respondents. The writ petition is disposed of accordingly. Consequently connected miscellaneous petition is also closed. No costs.
