JUDGMENT

[Judgment of the Court was delivered by D.KRISHNAKUMAR, J.] This Appeal has been preferred challenging the order of the learned Single Judge passed in W.P. No. 26981 of 2013, in and by which, the appellants herein were directed to count half of the service rendered by the respondent/petitioner herein and others as Social Forestry Workers/Plot Watchers/Mazdoors on daily wages basis along with their regular service as qualifying service and to grant pension/family pension and other consequential monetary benefits to the respondent/petitioner herein and others.

2. The respondent/petitioner has also relied upon G.O.(Ms). No. 50, Environment and Forest (FR.2) Department, dated 09.04.2015 wherein similar relief has been granted to the petitioners mentioned therein, by counting 50 percent of the service rendered by them as Plot Watcher on 2/5

daily wages along with the regular service rendered by them as qualifying service and eligible pension and other consequential benefits have also been granted and therefore the respondent/petitioner is also entitled for similar relief as that of the petitioners mentioned in the said Government Order.

3. The learned Additional Government Pleader has placed Letter No. 10640/FR2(II)/2017-1, dated 02.03.2018, from which it is seen that pursuant to the orders dated 22.8.2014 passed in W.P. No. 22783/2014 and various other Writ Petitions, the Government have decided to regularize the service of the respondent/writ petitioner herein and others and to refix their seniority on par with that of their juniors in the post of Forest Watcher notionally, with monetary benefits from the date of issue of that letter.

The learned Additional Government Pleader further submitted that in the light of the aforesaid letter, the seniority of the respondent/writ petitioner herein and others had been revised and refixed on par with their juniors with effect from the date of the letter dated 02.03.2018 and monetary benefits have also been received by the respondent/petitioner herein and others.
