Respondents Prayer: Petition filed under Article 226 of the Constitution of India praying for a writ of mandamus, directing the respondents herein to provide compassionate appointment to the petitioner in the first respondent Tamil Nadu State Transport Corporation (Villupuram) Ltd for the death of the petitioner's father, deceased employee Mr.Suresh Babu, who died in harness on 29.01.2023, considering the petitioner's representation dated 04.12.2023.

ORDER

The present writ petition is filed with the prayer to consider the petitioner's application dated 04.12.2023. In the said representation, the petitioner has prayed to appoint her on compassionate basis.

2. It is the case of the petitioner that the petitioner's father Thiru.Suresh Babu, who was in the service of the respondent Corporation died in harness while in service on 29.12.2023. The petitioner possesses valid Conductor license, therefore, she applied for compassionate appointment. Since the application of the petitioner is not considered, she is before this Court.

3. Mr.R.Venkatesaperumal, learned counsel, taking notice on behalf of the respondent Corporation, would submit that as far as the post of Conductor is concerned, there is a minimum physical standard of height, but the petitioner does not satisfy the same. The petitioner does not possess the minimum height of 160 cms.

4. Be that as it may, when the application for compassionate appointment is made, if the petitioner is not eligible for the job of Conductor, then the said application could be considered for other eligible Grade III or Grade IV posts, which could be filled up by way of compassionate appointment as per the seniority of the petitioner.

5. Therefore, the respondents are directed to consider the petitioner's application dated 04.12.2023 in accordance with the law and policy and pass others thereon.

6. With the above observations, the writ petition stands disposed of. There shall be no order as to costs. 20.06.2024 drm
