Dr.R.Gouri, Government Counsel for R1 to R3 Judgment (Judgment of the Court was delivered by S.M.Subramaniam J.) The writ order dated 23.02.2026 passed in W.P.No.25697 of 2024 is under challenging in the present writ petition.
2. The writ petitioner is the appellant herein. The appellant states that he was appointed as a Game Marker at Vijayanta Higher Secondary school at Avadi in a sanctioned post on daily wages basis. However, there is no order of appointment produced. When the appellant could not able to produce any records to show that he was appointed in accordance with the recruitment rules in force, the writ Court found that in the non-teaching vacancy post one Mr.Vijayan was appointed and the appellant was not even appointed in the School. Therefore, the appellant could not able to establish even his appointment in the School. Under those circumstances, the writ Court arrived at a conclusion that the appointment of the appellant was never established nor any such proposal was forwarded to the Government for approval by the Aided School.
3. That being the factum, the relief as sought for regularisation of service would not arise at all. The Writ Court dismissed the writ petition on the said ground which cannot be construed as infirm. Consequently, the Writ Appeal stands dismissed. No costs.
