The petitioner, who was arrested and remanded to judicial custody on 05.07.2021 for the offences punishable under Sections 354 A, 354 D of IPC & 4 of TNPHW Act altered to 354 A, 354 D, 376 IPC & 4 of TNPHW Act in S.C.No.373 of 2021 on the file of the Magalir Neethimandram, Chennai seeks bail.

2. The case of the prosecution is that on 05.07.2021, the petitioner committed sexual assault on the victim girl. The de-facto complainant, on hearing the scream of the victim girl, secured her and lodged the complaint.

3. The victim is aged about 25 years and mentally retarded girl. The petitioner had taken the victim and committed rape on her.

4. Therefore, the petitioner has committed very serious and heinous offence as against the mentally retarded person and this Court is not inclined to grant bail to the petitioner.
