ORDER

This Writ Petition (Criminal) has been filed seeking a direction to forbear the respondents from preventing the members of the petitioner Club from playing the game of rummy, along with carom board, table tennis, chess, gym, billiards and library, at No.83/53, Raja Street, Near Kaliyamman Koil Street, Komarapalayam, Namakkal District, by using the tokens. 2.

Heard the learned counsel appearing on either side and perused the materials available on record.

The petitioner is a registered Club under the Societies Registration Act, situated at No.83/53, Raja Street, Near Kaliyamman Koil Street, Komarapalayam, Namakkal District. The members of the club actively participate in the furtherance of the objects of the club as provided in its Bye-laws. The club also provides indoor games such as chess, carom board, table tennis, playing cards, etc. While being so, the third respondent

periodically visiting the club and threatening its members despite there being no illegal activity or violation of law. Therefore, the petitioner had already filed a W.P.No.6171 of 2025 before this Court. By order dated 21.02.2025, this Court permitted the petitioner to conduct rummy and other indoor games on certain conditions, including the installation of CCTV cameras in the club. The petitioner had duly complied with all the conditions imposed by this Court. However, even thereafter, the third respondent, under the guise of inspection, continues to interfere with and disturb the day-to-day lawful activities of the club.

The learned Counsel for Government of Tamil Nadu (Criminal Side) submitted that the respondents have been conducting only periodical inspection of the petitioner's premises and have not interfered with any lawful activities of the club.

Considering the above facts and circumstances, the third respondent is directed not to interfere with the day-to-day lawful activities of the petitioner's club and its members. However, if the petitioner or its members indulges in any illegal activity, the third respondent is at liberty to take appropriate action in accordance with law.

With the above direction, this Writ Petition (Criminal) stands disposed of. Consequently, connected miscellaneous petition is closed. No costs.
