The present criminal original petition has been filed seeking suitable directions to respondent police to register the complaint dated 26.3.2015, forwarded to the respondent by the Commissioner of Police, Chennai.
2. The petitioner has lodged a complaint on 26.3.2015 before the Commissioner of Police, Chennai as against one S. Kandasamy on the allegation of land grabbing and execution of bogus sale deeds. The said complaint was forwarded by the Commissioner of Police to the respondent for appropriate action. Since no action was taken by the respondent on the said complaint, the petitioner has filed the present criminal original petition.
3. Today, when the matter was taken up for consideration, learned Additional Public Prosecutor submitted that on the complaint dated 26.3.2015 given by the petitioner, an enquiry https://hcservices.ecourts.gov.in/hcservices/
was conducted and the same was closed as civil in nature and to that effect, he has also produced a closure report before this court and served the same to the petitioner.
4. In view of the submission made by the learned Additional Public Prosecutor, since the complaint has been closed as civil in nature, nothing survives for adjudication in this criminal Original petition. Hence, the present criminal original petition is dismissed. However, the petitioner is at liberty to work out his remedy under Section 156(3) of Cr.P.C.
