PRAYER: Writ Petition is filed under Article 226 of Constitution of India, praying for the issuance of Writ of Mandamus direction against the 1st and 2nd respondents, directing them to grant appropriate protection from the trespassing and interference being committed by the 4th and 5th respondents, their men agents, representatives, or any other persons acting through or under them, in the properties more fully described in the schedule to this Writ Petition. ORDER
This Writ Petition has been filed seeking a direction against the respondents 1 and 2 to provide appropriate protection against the acts of trespass and interference allegedly committed by the respondents 4 and 5, their men agents, representatives, or any other persons acting through or under them, in respect of the properties more fully described in the schedule to this Writ Petition.
2. The case of the petitioner is that he is the auction purchaser of the subject property pursuant to the auction conducted by the third respondent. The respondents 4 and 5 were the original borrowers and owners of the subject property. However, due to default committed by them, the property was brought to auction sale. After purchasing the property, the petitioner has not in possession and enjoyment of the same. While so, the respondents 4 and 5 allegedly attempted to trespass into the subject property and disturb the peaceful possession and enjoyment of the petitioner. Therefore, the petitioner lodged a complaint before the second respondent, which is stated to be pending.
3. In view of the above, the second respondent is directed to conduct an enquiry on the complaint lodged by the petitioner, after issuing notice to the petitioner as well as the respondents 4 and 5, and take appropriate action in accordance with law, if any prima facie material is available against the respondents 4 and 5.
4. It is also made clear that the second respondent shall peruse the documents produced by the petitioner and the respondents 4 and 5 and pass appropriate orders on merits and in accordance with law, as expeditiously as possible.
