Prayer : The writ petition filed under Article 226 of the Constitution of India to issue a Writ of Certiorarified Mandamus, calling for the records of the first respondent in Pro.Na.Ka.No.A2.2959/08(2) dated 23.04.2008, quash the same and to direct the respondents 1 and 2 to allow the petitioner to continue to serve as Sub Inspector of Survey, O/o. ORDER

The petitioner prays to issue a Writ of Certiorarified Mandamus, calling for the records of the first respondent in Pro.Na.Ka.No.A2.2959/08(2) dated 23.04.2008, quash the same and to direct the respondents 1 and 2 to allow the petitioner to continue to serve as Sub Inspector of Survey, O/o. The Special Tahsildar ( Land Acquisition.IV), Neyveli.

The petitioner's contention is that when he was working as Sub Inspector of Survey in the office of the second respondent, he was ordered to be transferred to Mobile Squad, Cuddalore vide order Pro.Ka.No.A2.2959/08(2) dated 23.04.2008, based on the motivated report of the third respondent dated 05.04.2008, alleging indiscipline in his official duties. It is his further contention that no explanation has been called for from him and no charges have been framed against him regarding the alleged indiscipline on his part, and the original order has not been served on him and he was not yet relieved. Aggrieved against the order Pro.Ka.No.A2.295908/08(2) dated 23.04.2008, the petitioner has approached this Court by way of filing this writ petition.

The learned counsel for the petitioner would contend that after filing of this WP, in obedience to the above order of transfer dated 23.04.2008, the petitioner has joined duty at Mobile Squad, Cuddalore on 07.05.2008 and from there, he was ordered to be transferred to Chidambaram vide order dated 13.06.2008, which is under challenge in another W.P.No.15925 of 2008 filed by the petitioner.

4. In view of the above statement made by the learned counsel for the petitioner, this Writ Petition is dismissed as having become infructuous. No costs. Consequently, connected Miscellaneous Petitions is closed.
