Petition praying that in the circumstances stated therein the High Court will be pleased to relax the condition made in Crl.M.P.No.2 of 2015 in Crl.A.No.25 of 2015 dated 01.09.2016. Order : This petition coming on for orders upon perusing the petition and upon hearing the arguments of M/S.K.SHANKER, Advocate for the petitioner and of MR.R.RAVICHANDRAN, Government Advocate (Crl.Side) on behalf of the Respondents the court made the following order:- It is represented on behalf of the Petitioner / Appellant / Accused that he is abiding the condition imposed by this Court in M.P.No.2 of 2015 in Crl.A.No.25 of 2015 dated 01.09.2016 without any default till date. In this connection, the Learned First Additional District and Sessions Judge, Thiruvallur had also addressed a communication to the office of the Registry dated 30.01.2017 stating that the Petitioner / Appellant is abiding the condition imposed by this Court in M.P.No.2 of 2015 in Crl.A.No.25 of 2015 dated 01.09.2016.
2. The factum of abiding the condition by the Petitioner / Appellant / Accused in Crl.M.P.No. 1 of 2015 is not disputed on behalf of the Respondent / Prosecuting Agency.
3. Considering the fact that the Petitioner / Appellant / Accused is abiding the condition imposed by this Court in M.P.No.2 of 2015 in Crl.A.No.25 of 2015 without any default till date and also this Court taking note of the fact that the Petitioner / Appellant finds it difficult to appear before the trial court on all working days at 10.30 a.m, in the interest of justice, relaxes the condition by directing the Petitioner / Appellant to appear before the First Additional District and Sessions Judge, Thiruvallur once in a week, namely, on every Monday, in a week at 11.00 a.m. until further orders.
With the aforesaid observation, this Petition is disposed of. -sd/- 01/02/2017 This order, on being produced, be punctually observed and carried into execution by all concerned TRUE COPY Sub-Assistant Registrar (Statistics/C.S.) High Court, Madras - 600 104.
