ORDER

The petitioner, who apprehends arrest at the hands of the respondent police for the offences punishable under Section 309 (3), 311 and 351 (3) of BNS in Crime No.138 of 2025, seeks anticipatory bail.

2.The case of the prosecution is that the petitioner has committed theft of Rs.2000/- at knife point from the defacto-complainant. Hence the case. 3.The learned counsel appearing for the petitioner submitted that the petitioner is an innocent person and he has been falsely implicated in this case. He further submitted that the custodial interrogation of the petitioner is not required and sought for anticipatory bail to the petitioner. 4.The learned Additional Public Prosecutor reiterated the prosecution case and submitted that petitioner is having two previous cases. Hence, he vehemently opposed for grant of anticipatory bail to the petitioner. 5.Head the learned counsels on either side and perused the records. 6.Since, the petitioner has committed very serious and heinous offence, the custodial interrogation of the petitioner is very much required. Hence, this Court is not inclined to grant bail to the petitioner.
