Nagoor Gani v. The Mayor
W.M.P.No.20795 of 2025 in W.P. No.18524 of 2025 W.M.P.No.20795 of 2025 in W.P. No.18524 of 2025 M.SUNDAR, J.
and HEMANT CHANDANGOUDAR, J.
[Order of the Court was made by M.SUNDAR, J.] This order will now dispose of the captioned 'Writ Miscellaneous Petition' [hereinafter 'WMP' for the sake of brevity]. 2.
Captioned WMP has been filed with prayer to dispense with production of 'original impugned letter dated 21.05.2024 bearing reference Na.Ka.En.1654/2024' [hereinafter 'impugned letter' for the sake of brevity, convenience and clarity]. 3.
Mr. R. Vinayaga Vishnu, learned counsel on record for writ petitioner, is before this Court.
4.
Learned counsel for writ petitioner submits that the original impugned letter was not readily available with writ petitioner at the time of filing of captioned writ petition and therefore, photocopy of the impugned letter was filed along with the typed set of papers and that has necessitated the captioned WMP. cad 5.
Taking into account the fact that the authenticity of the impugned letter is not subjected to contestation or disputation, as a one off case, we are considering the dispense with prayer making it clear that in the days to come, adequate articulation in the support affidavit is imperative.
6.
In the light of the narrative thus far, dispense with prayer is acceded to. Captioned WMP is ordered as prayed for. [M.S., J.] [H.C., J.] 10.06.2025 cad W.M.P.No.20795 of 2025 in W.P. No.18524 of 2025 Page Nos.2/2 https://www.mhc.tn.gov.in/judis
