O R D E R
The petitioner has come forward with this Criminal Original Petition seeking for a direction to direct the respondent to register a case based on the complaint lodged by the petitioner dated 18.12.2015 on the file of the respondent police against the named persons mentioned in the complaint.
2. The petitioner herein has lodged a complaint against one Gunasekaran, Rakesh, Panneerselvam, Paramasivam and Advocates of some local rowdies stating that the petitioner is a representative of a company by name G7 Investments Pvt. Ltd. The said company purchased lands measuring 350 acres in Mannargudi Taluk, one Dharmendra and Sadhasivam are cultivating the said land under lease. It is further stated that regarding the above said land, a suit in O.S.No.10 of 2015 is pending before the Sub Court, Mannargudi. Whileso, on 18.1.2015, the above said five persons along with some local rowdies came and threatened the petitioner with dire https://hcservices.ecourts.gov.in/hcservices/
consequences. Hence the petitioner lodged a complaint before the respondent police on 18.12.2015, but till date, no action has been taken to register the same. Hence the petitioner is before this Court.
3. I have heard the learned counsel appearing for the petitioner and the learned Additional Public Prosecutor appearing for the respondent.
4. Learned counsel for the petitioner submitted that though the complaint was lodged on 18.12.2015, till date, no action has been taken. Hence, the present criminal original petition has been filed.
5. Learned Additional Public Prosecutor submitted that on receipt of complaint, the same has been assigned in C.S.R.No.387 of 2015 .
6. From the facts and circumstances of the case, I find that the complaint lodged by the petitioner has been assigned CSR number as C.S.R.No.387 of 2015. Hence, this Court directs the respondent to conduct enquiry in C.S.R.No.387 of 2015 and upon enquiry, if materials are gathered indicating any cognizable offence, the respondent shall proceed further in accordance with law as early as possible. If no prima facie case is made out for investigation, the respondent is directed to pass appropriate order on the complaint and proceed further in accordance with law, as early as possible.
7. The criminal original petition is disposed of accordingly.
