Respondents Prayer: The Writ Petition filed under Article 226 of the Constitution of India for issue a Writ of Mandamus directing the 1st respondent to issue Nativity/Residence Certificate to the petitioner.

By consent, the writ petition is taken up for final disposal at the admission stage itself.
2. The case of the petitioner is that she is a native of Puducherry by virtue of birth and permanent residence and the first respondent has issued nativity/residence certificate on
26.08.2011 and community certificate on 23.10.2015. It is further claimed that she was selected by the second respondent for appointment to the post of primary school teacher and now, the second respondent is seeking her nativity/residence certificate. The petitioner applied for a nativity certificate with the first respondent and the same was not issued. Therefore, the petitioner submitted a representation dated 28.10.2015 seeking a nativity/residence certificate. But it was not considered so far. Hence, the present writ petition.

The learned counsel for the petitioner submitted that the second respondent has now issued a letter dated 11.11.2015 directing the petitioner to produce her nativity/residence certificate on or before 25.11.2015, failing which, the provisional selection will stand cancelled and therefore, praying for an interim order.
4. The learned counsel for the respondents submitted that the petitioner was already married and she is now not residing in Puducherry.
5. Considering the submissions made by both sides and without going into the merits of the case, the first respondent is directed to pass appropriate orders on the petitioner's representation dated 28.10.2015, on merits and in accordance with law, within a period of four weeks from the date of receipt of a copy of this order. The second respondent is directed to reserve one seat till the decision taken on the representation of the petitioner.
With the above directions, the writ petition is disposed of. No costs. Consequently, connected miscellaneous petition is closed.
