ORDER

This petition has been filed to relax the condition in para No.7(b) imposed on the first petitioner herein in Crl.O.P.No.9456 of 2025, dated 01.04.2025, that the petitioner herein shall report before the respondent police everyday at 10:30 a.m., until further orders. 1/4

The learned counsel appearing for the petitioner submits that the petitioner herein was granted anticipatory bail by this Court, vide order dated 01.04.2025 in Crl.O.P.No.9456 of 2025 with one of the condition that the petitioner herein has to report before the respondent police everyday at 10:30 a.m., until further orders. He further submitted that the petitioner herein had complied with the said condition for three days i.e., from 18.04.2025 to 20.04.2025 and since the petitioner is a Marine Engineer, he was asked to board a ship, therefore he was unable to comply with the condition and sought for relaxing the aforesaid condition.

The learned Government Advocate (Crl.Side) appearing for the respondent submitted that the petitioner had executed the sureties and complied with the condition imposed on him by this Court, vide order dated 01.04.2025 in Crl.O.P.No.9456 of 2025 only for three days and thereafter, not complied with the condition. He further submitted that steps are being taken to arrest the petitioner for non-compliance of the condition. 4.

The learned counsel appearing for the defacto complainant submitted that the defacto complainant is following up her complaint given 2/4

against the petitioner herein and his family members. He further submitted that the respondent police had sent a letter to the Director General of Shipping, Government of India, Mumbai requesting appropriate action against the petitioner herein and not to permit him to board any ships. After the receipt of the letter, the petitioner had signed off from the ship. He further submitted that the defacto complainant had sent her representations to the Commissioner of Police, Assistant Commissioner and Deputy Commissioner regarding the non-compliance of the conditions imposed on the petitioner herein by this Court, vide order dated 01.04.2025 in Crl.O.P.No.9456 of 2025 and further, the respondent police had not taken any action against the petitioner herein. 5.

Considering the submissions made and the nature of offence the condition in para No.7(b) imposed on the petitioner herein in Crl.O.P.No.9456 of 2025, dated 01.04.2025 is modified to the effect that the petitioner shall report before the respondent police everyday at 10:30 a.m., from 14.07.2025 onwards, until further orders. It is also made clear that if the petitioner had not complied with the condition, the respondent police shall take necessary steps against the petitioner, immediately in accordance with law.
