ORDER

Petition seeking bail in connection with Crime No.187 of 2026 registered for the offences punishable under Sections 126, 127(2), 140(1), 309 and 351(3) of BNS, is on board for consideration. 2.

The case of the prosecution is that due to previous enmity, the petitioner, who was an employee of the de facto complainant, along with other

accused kidnapped the de facto complainant for ransom of Rs.1 crore. Hence the case.

Learned counsel appearing for the petitioner submitted that the petitioner is an innocent person and has been under incarceration since 08.03.2026. He further submitted that due to the business rivalry, a false complaint has been given against the petitioner. He also submitted that the coaccused in this case has been released on bail and that the petitioner is ready to abide by any stringent condition that may be imposed by this Court. Hence, he prayed for the grant of bail to the petitioner. 4.

Learned Government Advocate (Criminal Side) appearing for the respondent reiterated the prosecution case and opposed for the grant of bail. He further submitted that the investigation in this case is still pending and only part of the amount was recovered. He also submitted that this is the second application for bail filed by the petitioner and that the first application for bail in Crl.O.P.No.9333 of 2026 was dismissed by this Court on 15.04.2026 and there is no change in circumstances.

Heard both sides and perused the materials available on record.

Considering the facts and circumstances of the case, the gravity of the offence committed by the petitioner and taking note of the fact that there is no change in circumstances, this Court is not inclined to grant bail to the petitioner.
