ORDER

The petitioner herein is the accused in Crime No.141 of 2024 pending investigation on the file of the first respondent police.

2. The learned counsel appearing for the petitioner states that a goat owned by the petitioner was stolen by the second respondent and the petitioner also sustained injury at the hands of the second respondent. However, a false complaint given by the second respondent was taken up for investigation in Crime No.141 of 2024, to the counter blast to a complaint given by the petitioner in Crime No.135 of 2024 on 18.05.2024 regarding the occurrence.

The learned Government Advocate (Crl.Side) submitted that there are two cases registered, one against this petitioner in Crime No.141 of 2024 and another by the petitioner against Namachivayam in Crime No.135 of 2024. Since there is a case and case-in-counter, after identifying the aggressor and the truthfulness of the case, the final report will be filed in accordance with law and with available materials. -2-

4. By taking note of the fact that for the same incident, two complaints are received, it is appropriate to direct the first respondent police to follow the procedure as contemplated under 588A of the Police Standing Order and the directions of this Court pertaining to the case and case-incounter and file a final report within a period of two months from the date of receipt of a copy of this order.

With the above direction, this Criminal Original Petition is disposed of. Consequently, the connected Miscellaneous Petition is closed. 25.06.2024 asi To
