In a proposed suit seeking relief in respect of alleged trademark infringement and passing off, the applicant seeks leave to sue the respondent before this Court. The applicant asserts that both the plaintiff and the defendant are engaged in the business of manufacturing and marketing metallurgical equipment. Learned counsel submits that the defendant sells its products commercially within the jurisdiction of this Court as evidenced by the documents at pages 86 and 87 of the typed set of papers.

2. Upon examining the draft plaint and considering the above submissions, the cause of action has arisen at least partly within the jurisdiction of this Court. Therefore, A.No.3524 of 2022 is allowed by granting leave to the applicant to institute the suit against the respondent before this Court.
