2022-07-15Honourable Mr Justice R. Subramanian2 pages

W.M.P.No.16917 of 2022 in W.P.No.17857 of 2018 W.M.P.No.16917 of 2022 in W.P.No.17857 of 2018 R.SUBRAMANIAN, J.

The petitioner seeks extension of time granted to vacate the property and hand over the possession to the Housing Board, till such time the Housing Board conducts the re-auction. This request cannot be granted, since the Housing Board cannot conduct re-auction unless it is put in possession of the property.

2. Mr.U.Venkatesan, learned counsel appearing for the petitioner would plead that the petitioner would vacate if some time is granted.

3. Considering the fact that the petitioner is in possession and he is running a business, the petitioner is granted time till 31.08.2022 to vacate and hand over the possession. It is made clear that no further time will be granted. If the petitioner does not vacate by 31.08.2022, it will be open to the Housing Board to evict him, apart from initiating appropriate contempt proceedings against the petitioner in this regard. 15.07.2022 hvk https://www.mhc.tn.gov.in/judis
