The instant writ petition has been filed with a prayer for issuing a Mandamus, to direct the respondent to pay the interest at the rate of 18% for the period from 31.05.2018 to 26.08.2019 for delayed payment of retirement benefits and to pay the other benefits such as amount of earned leave surrender and other benefits payable to the petitioner with interest.
2. The case of the petitioner is that the petitioner was joined in the respondent corporation as a conductor on 18.04.1985 and he was retired from service on 31.05.2018. However, the terminal benefits have been settled to him only on 26.08.2019 and no interest has been paid for the delayed period.

The learned counsel for the petitioner would invite the attention of this Court about the RTI reply given by the respondent vide reply dated 15.09.2023, wherein, the respondent has admitted the entitlement of the petitioner's E.L surrender to the tune of Rs.37,470/- and further more in respect of the delayed payment.

4. At this juncture, the learned Standing Counsel for the respondent would fairly submit that they would pay 6% interest on the eligible amount.

In such view of the matter, this Court without going into merits of the matter, deems it appropriate to direct the respondent to settle the E.L surrender to the tune of Rs.37,470/- and interest at the rate of 6% pa upon the delayed payment of terminal benefits on its own merits and in accordance with law, within a period of six weeks from the date of receipt of a copy of this order.
6. In the result, this Writ Petition is disposed of with the above observations. No costs.
