W.M.P.Nos.16759, 16761 of 2023 W.M.P.Nos.16759, 16761 of 2023 and W.P.No.266 of 2014 V.LAKSHMINARAYANAN.J, The petitioner is a workman. He was dismissed from service on 28.02.2011. The approval petition filed by the Management, was dismissed on 27.12.2012. Challenging the same, the present writ petition has been filed. The result of the dismissal of the approval petition is that the petitioner continues to be in service. The interim stay was granted by this Court on 07.01.2014. The approval petition having been dismissed, the petitioner is deemed to have been in service. By virtue of a Constitution Bench decision of the Supreme Court, the petitioner has also filed an affidavit before this Court that he is not gainfully employed and willing to appear for work.
2. Therefore, W.M.P.No.16761 of 2023 is allowed. The petitioner will be paid his last drawn wages of Rs.13,576/- per month. In W.M.P.No.16759 of 2023, the petitioner will be entitled to the arrears to be paid from the date of interim order of this Court till today. The said payment shall be made within a period of twelve weeks from the date of receipt of a copy of this order.
