CR.NO.2/AC/2005/KM Petition praying that in the circumstances stated therein and in the Memorandum of Grounds in Criminal APPEAL No.375 OF 2017 on the file of the High Court, the High Court will be pleased to suspend the sentence awarded in the judgment dated 27.06.2017 made in Special Case No.5 of 2006 on the file of the Court of Special Judge and Chief Judicial Magistrate, Chengapattu and enlarge the petitioner on bail pending disposal of this CRL.A.No.375/2017.
Order : This petition coming on for orders upon perusing the petition and the Memorandum of Grounds in Crl.A.No.375 of 2017 on the file of the High Court and upon hearing the arguments of MR.S.KARTHIKEYAN, Advocate for the petitioner and of MR. R.RAVICHANDRAN, Government Advocate (Crl.Side) on behalf of the Respondent the court made the following order:- Seeking to suspend the sentence imposed on the petitioner by the learned Special Judge and Chief Judicial Magistrate, Chengalpattu made in Spl.Case.No.5 of 2006 dated 27.06.2017 and enlarge the petitioner on bail pending disposal of criminal appeal, the petitioner is before this Court with this petition.
2. Heard the learned counsel for the petitioner and the learned Government Advocate (crl.side) appearing for the respondent.
3. This Court has already fixed date as 15.09.2017 for final disposal. Considering the fact that the petitioner has already been in judicial custody for the past 70 days, I am inclined to allow this miscellaneous petition and the order passed by the learned Special Judge and Chief Judicial Magistrate, Chengalpattu made in Spl.Case.No.5 of 2006 dated 27.06.2017, is suspended for two months on condition that the petitioner shall execute a bond for a sum of Rs.1,00,000/- (Rupees One lakh only) with two sureties each for a like sum to the satisfaction of the learned Special Judge and Chief
Judicial Magistrate, Chengalpattu. Further, the petitioner shall appear before the trial Court on every second Monday of every month at 10.30 a.m until further orders.
