ORDER

This petition has been filed seeking direction to the learned Judicial Magistrate No.II, Panruti, to dispose of the case in S.T.C.No.87 of 2011 as expeditiously as possible.

According to learned counsel for the petitioner, in this case totally four accused and one of the accused has been absconded and Non Bailable Warrant was issued. The case is pending from the year 2011 without any progress. Therefore direction to the learned Magistrate is necessary for the speedy disposal of the case in S.T.C.No.87 of 2011. It is seen that the occurrence is of the year 2009 and the case is of the year 2011. Further one of the accused has been absconded and hence NBW was also issued against him and the same is pending for a long time, which stalled the proceedings of trial in the above case. Considering the nature of prayer sought for in this petition and the fact that the case is pending from the year 2011, the learned Judicial Magistrate No.II, Panruti, is directed to split up the case against the absconding accused and expedite the trial against the remaining accused and dispose of the case in S.T.C.No.87 of 2011 as expeditiously as possible. Further the learned Magistrate is directed to take effective steps to secure the 2/4

absconding accused.

with the above directions, this Criminal Original Petition stands disposed of.
