PRAYER : Criminal Original Petition has been filed under Section 482 of Criminal Procedure Code, to transfer the investigation in Crime No.3 of 2023 dated 01.05.2023 pending on the file of the 2nd respondent police to 3rd respondent.

ORDER

The petitioner herein is the defacto complainant in Crime No.3 of 2023 on the file of the second respondent police alleging that the Police has not been properly investigating the case and the suspected accused are at large, though several crores of money been cheated by them, no recovery made by the respondent police. The present petition is filed seeking transfer of investigation.

2.Against the same accused, in respect of another complaint of similar nature registered in Crime No.4 of 2023 on 01.05.2022, similar request was made by the defacto complainant and this Court after considering the facts has passed an order dated 20.10.2023, directing the District Superintendent of Police to examine the investigation conducted so far, and if not satisfactory, to change the investigating agency and monitor the investigation and file final report within a period of 45 days.

3. The learned counsel appearing for the petitioner submitted that, the above order was passed on 20.10.2023 in respect of other petitioners, three weeks already gone but there is no progress in the investigation. Page No.2/4

The learned Government Advocate (Crl.Side) appearing for the respondents states that the matter has been taken into consideration by the Superintendent of Police, as per the direction of this Court dated 20.10.2023, investigation is expedited and also submitted that as far as A3 is concerned, he has filed bail petition and the same is pending before this Court and A4 and A5 are still absconding and a team to be constituted for securing them.

5. Recording the same, the Superintendent of Police, Erode attached to the District Crime Branch is directed to monitor the investigation and expedite the process by constituting a special team to secure the absconding accused.
