ORDER

(Order of the Court was made by M.S.RAMESH, J.) The gist of the complaint is that the petitioner had illegally arrested the complainant and had demanded Rs.1,500/- as penalty, apart from assaulting him. Insofar as the allegation with regard to the demand of bribe is concerned, the State Human Rights Commission had found the same to be proved. However, with regard to the allegation of assault, it was recorded that the same was unproved. In this background, recommendations were made through the impugned order of the Government, to pay a compensation of Rs.25,000/- to the complainant and recover the same from the petitioner.

2. When the State Human Rights Commission, on the basis of its oral and documentary evidences, had come to the conclusion that the petitioner had not assaulted the complainant, we fail to understand as to how there could be any violation of human rights. Insofar as the allegation that the petitioner has demanded bribe, alternate remedies are available to the

complainant to workout his remedies and thus, recommendation of payment of compensation for this charge may not be proper.

3. In the light of the above observations, the Writ Petition stands allowed and the impugned order dated 05.05.2021 passed in SHRC Case No.1877 of 2019 is hereby quashed. No costs. Connected miscellaneous petition is closed.
