The petitioner, who was arrested and remanded to judicial custody on 03.06.2022 for the offences punishable under Section Girl Missing altered into Section 366 of IPC and Sections 5(l), 6 of POCSO Act in crime No.26 of 2022 on the file of the respondent police, seeks bail.
2. The case of the prosecution is that de-facto complainant's daughter aged 17 years studying 12th standard fell in love with the petitioner and they eloped for the purpose of marriage on 01.06.2022. Hence, the complaint.
3. On perusal of the statement recorded under Section 164 of Cr.P.C. revealed that on the pretext of love affair and also marriage, the petitioner had committed penetrative sexual assault on the victim girl.
4. Therefore, the petitioner had committed very serious and heinous offence as against the victim girl and this Court is not inclined to grant bail to the petitioner. Hence, this Criminal Original Petition is dismissed. 18.07.2022 mpl https://www.mhc.tn.gov.in/judis
