ORDER

Challenging the impugned order passed in I.A.No.25 of 2024 in H.M.O.P.No. 193 of 2022 by the learned Sub-Judge, Chidambaram with regard to the payment of interim maintenance, the Revision Petitioner husband preferred this Civil Revision Petition.

2.Before the trial court, the Revision Petitioner husband filed a petition in H.M.O.P.No. 193 of 2022 and the same is pending before the Sub-Court, Chidambaram. Meanwhile, the respondent wife filed an application seeking for interim maintenance. On considering the income of revision petitioner husband, who is working as HR Manager and receiving salary around Rs.1 lakh and also receiving rent from the immovable property, the trial judge had passed an order directing the revision petitioner husband to pay a sum of Rs.12,000/- to the respondent wife. Aggrieved over that, he preferred this Civil Revision Petition.

3. The learned counsel for revision petitioner husband would submit that the respondent wife is employed as Nurse and she is also not living with him and separated from the matrimonial home. Hence, he raised objections and prayed to set aside the findings rendered by the trial judge.

As rightly pointed out by the learned counsel for the revision petitioner that the respondent wife filed the petition in H.M.O.P.No.193 of 2022 for restitution of conjugal rights and subsequently, she filed an application seeking interim maintenance to her till the disposal of H.M.O.P. Admittedly, the revision petitioner husband is working as HR Manager, in which he is receiving reasonable salary and the respondent is also employed as Nurse. Considering

that, this Court is inclined to direct the revision petitioner husband to pay a sum of Rs.10,000/- towards interim maintenance along with accrued arrears of maintenance to the respondent wife till the completion of H.M.O.P. proceedings. Both parties are directed to co-operate with the trial proceedings before the trial court. If the amount is not paid, he is not entitled to proceed with the proceedings in H.M.O.P.No. 193 of 2022. Accordingly, this Civil Revision Petition is disposed of. No costs.
