Petition filed under Article 226 of the Constitution of India to issue a Writ of Mandamus directing the Respondent to grant one increment to the petitioner for the period from 01.01.2005 to 31.12.2005 with all benefits and thereby revise and re-fix the retirement service benefits of the petitioner and to pay the arrears thereon to the petitioner for which he has lastly made representation dated 17.11.2014.

2. The case of the petitioner is that he was initially appointed as a typist on 08.03.1973 in Agricultural Engineering Department at Cuddalore and he retired from service on attaining the age of superannuation on 31.12.2005 as the Superintendent in https://hcservices.ecourts.gov.in/hcservices/

the respondent office. According to the petitioner, he is entitled for benefits given under G.O.Ms.No.311 dated 31.12.2014, Finance (CMPC) Department. Hence, he submitted a representation to the respondent on 17.11.2014. But it has not been considered so far. Hence, the present Writ Petition has been filed.

3. Heard the submissions of Mr.R.Malaichamy learned counsel for the petitioner and Mr.V.Jayaprakash Narayanan, learned Special Government Pleader who accepts notice on behalf of the respondent.

4.Though the petitioner prayed for a larger relief, this Court taking into consideration the facts and circumstances of the case, directs the respondent to consider and dispose of the representation of the petitioner dated 17.11.2014 on merits and in accordance with law, and pass orders within a period of eight weeks from the date of receipt of a copy of this order and communicate the decision to the petitioner.
