This petition has been filed seeking restoration of Tr.CMP.No.476 of 2021, which was dismissed for nonprosecution on 17.08.2021. 2.Considering the fact that the Transfer Civil Miscellaneous Petition was dismissed at the admission stage without notice to the respondent, notice to the respondent in this petition is deemed unnecessary.

3.Accepting the reasons assigned in the affidavit filed in support of this petition and considering the fact that the petition has been filed on very next day of the dismissal, this petition is allowed, the order dismissing Tr.CMP.No.476 of 2021 is set aside and the same is restored on file.
