A.No.2691 of 2022 in C.S.(Comm. Div.) DR.No.70562 of 2022 SENTHILKUMAR RAMAMOORTHY, J In a proposed suit for trademark infringement and passing off, this application is presented for leave to institute the suit against the respondent before this Court.

2. Learned counsel for the applicant asserts that the suit is proposed to be filed before this Court both on account of the branch of the plaintiff being situated within the jurisdiction of this Court and on the basis that the impugned product is being sold commercially within the jurisdiction of this Court.

3. On considering the said submissions and on examining the draft plaint and documents, I find that at least a part of the cause of action has arisen within the jurisdiction of this Court. Accordingly, A.No.2691 of Page No.1 of 2

SETHILKUMAR RAMAMOORTHY, J kal 2022 is allowed by granting leave to the applicant to institute the suit against the respondent before this Court.

4. Registry is directed to number the plaint if it is otherwise in order.
