The present petition has been filed to modify the condition imposed on the petitioner in Paragraph No.10 of the order dated 14.02.2023 passed by this Court in Crl.O.P.No.3209 of 2023 while granting bail.

The learned counsel for the petitioner would submit that one of the conditions imposed on the petitioner is that "the petitioner should execute a bond for a sum of Rs.10,000/- with two sureties( out of which, one must be a blood related surety, who should produce document to show his/her means), each for a like sum to the satisfaction of the learned Additional District Judge and Presiding Officer, Special Court under E.C and NDPS Act Case (FAC), Salem. He would further submit that the petitioner lost his parents and the petitioner relatives also thrown out the petitioner from their relation, hence, he is not able to furnish blood surety for his release. He would further submit that the petitioner is now able to ready to furnish the local/friends surety for his release. Further, the friends of petitioner also daily coolie and 1/3
not having the properties in their name. Hence, he would seek to modify the aforesaid condition.
3. Heard the learned Government Advocate (Crl. Side) appearing for the respondent police.

Taking into consideration, the facts and the submissions made by the learned counsel for the petitioner, this petition is allowed by modifying the condition to the effect that " the petitioner is ordered to be released on bail on his executing a bond for a sum of Rs.10,000/- (Rupees Ten Thousand only) with two sureties, each for a like sum to the satisfaction of the learned Additional District Judge and Presiding Officer, Special Court under E.C and NDPS Act Case (FAC), Salem". All other conditions remain intact.
5. With the above modifications, this Criminal Miscellaneous Petition is allowed.
