JUDGMENT

A perusal of the records shows that this court by the order dated 20.04.2016 has recorded that the sole respondent died on 12.01.2013 and for taking steps, post the matter after vacation.

2. In the previous hearing i.e., 29.06.2018, the learned counsel for the respondent filed a memo stating that the sole respondent died on 02.01.2013. Hence, the matter has been posted today for taking steps to implead the legal representatives of the respondent.

3. Today also, the learned counsel for the appellant requests to grant some more time for taking steps to implead legal representatives of the respondent. Since, already five years over from the date of death of the respondent, the request made by the learned counsel for the appellant is rejected. Hence, the appeal is dismissed as abated.
