Respondents Petition filed under Article 226 of the Constitution of India praying for issue of Writ of Mandamus directing the first respondent to dispose of the petitioner's representation dated 20.03.2019 including Vending Committee constituted by the first respondent for grant licence continue to run the mobile tea shop and till such time, forbear the first respondent from in any manner interfering with the running of petitioner's bunk shop at on the line of Kasthuri Rangan Road, Near by Aswin Hospital, Gopalapuram, Chennai-600 086, selling tea, coffee and allied foods.

ORDER
(Order of the Court was made by The Hon'ble Chief Justice) Heard Mr.N.A.Sadique, learned counsel for the petitioner; Mr.V.C.Selvasekaran, learned counsel for the first respondent and Mr.S.Saravanakumar, learned counsel for the second respondent.
2. The case of the petitioner is that she is a hawker and doing hawking business on the road side of Kasthurirangan Road, near Aswin Hospital, Gopalapuram, Chennai-86. The prayer of the petitioner is that she be granted licence for running her business at the said place. Further case of the petitioner is that she has preferred a representation to the Commissioner, Corporation of Chennai to grant licence for running her business activities at the said place.

The learned counsel for the first respondent stated that the first respondent is not the correct authority to whom the representation ought to be addressed and the representation ought to have been addressed to the second respondent i.e., the Chairperson, Zone-IX Street Vending Committee, Corporation of Chennai, Chennai-34. Thus, it is seen that the petitioner has made the representation to the wrong authority.

In view of the above, liberty is granted to the petitioner to prefer a fresh representation to the second respondent i.e., the Chairperson, Zone-IX Street Vending Committee, Corporation of Chennai, Chennai-34 to grant her licence for carrying out vending business. If such representation is received by respondent No.2, the said representation to be disposed of as expeditiously as possible by respondent No.2.
The writ petition is disposed of in above terms. No costs. Consequently, W.M.P.No.18763 of 2019 is closed. s/d- Assistant Registrar(CO) True Copy Sub-Assistant Registrar bbr
