The petitioner seeks direction upon the respondent/Police to register a case on his complaint, dated 10.12.2014, given to the second respondent and to investigate the same and file final report before the competent court.

Heard the learned counsel appearing for the petitioner and learned Additional Public Prosecutor, representing the respondent/Police.

It is alleged that the petitioner purchased a property from one Vennila. Before the said purchase, the owner/Vennila had inducted one Chandra and Jayaram has sub tenants in the property in dispute, and the said two persons are still squatting in the property, as of right, on the basis of certain forged documents. It is also seen that, regarding the petitioner's complaint, enquiry was conducted by the respondent/Police and the petitioner has also given a letter, dated 13.12.2014, stating that, he will workout his remedy in the Civil Court.

According to me, the Police cannot determine the tenancy rights, for that would amount to usurping the jurisdiction of the Rent Control Court. Hence, this Criminal Original Petition is closed, with liberty to the petitioner to work out his remedy in the manner known to law.
