This Civil Miscellaneous Petition has been filed seeking to condone the delay of 197 days in filing the above Appeal Suit.

2. The learned counsel for the respondent fairly states that the delay of 197 days may be condoned and that the appeal may be disposed of on merits.

3. I have independently perused the affidavit filed in support of the petition seeking condonation of delay. I am satisfied that the petitioner has made out sufficient cause for not preferring the First Appeal within the period of limitation. The suit is one for recovery of money and, therefore, the appellant deserves an opportunity to contest the decree on merits.

4. In view of the foregoing reasons, this Civil Miscellaneous Petition stands allowed.
