This petition is filed to condone the delay of 709 days in filing the appeal.

Heard Ms.M.Malar, learned counsel for the petitioner.

It is submitted by the learned counsel for the petitioner that the first respondent is not a necessary party or a contesting party.

Therefore, no relief has been sought against the first respondent, hence, she seeks to give up the first respondent.

The same has been recorded and the first respondent is therefore removed from the array of parties.

The second respondent having been served and is represented by Ms.E.Malar, learned counsel, who makes objections with regard to the condoning the delay of 709 days and if at all the delay is condoned, the petitioner could not seek any interest during the delay period.

The said statement having been recorded, this petition is ordered and the delay of 709 days in filing the appeal is condoned and the petitioner cannot claim any interest during the delay period.
