Prayer:Writ petition filed under Article 226 of the Constitution of India, praying for the issuance of a Writ of Mandamus, directing the 2nd Respondent Bank to consider the case of the petitioner favourably for grant of compassionate Allowance as per Regulation 31(1) of the Pension Regulations within a time frame as may be fixed by this Court.

According to the petitioner, when the petitioner was working as Assistant Manager in the respondent Bank, he was transferred and posted at Edaikazhi branch, Kanchipuram Circle. Due to certain irregularities, the respondent initiated disciplinary proceedings and awarded punishment of dismissal from service against the petitioner.
According to the petitioner, as per Bi-partite settlement, the arrears amount of Rs.63,850/- is payable to the petitioner. However, the said amount was illegally withheld by the respondent. The petitioner has made representation to the respondent, however, no order has been passed for payment of arrears amount of Rs.63,850/-. Therefore, the petitioner requested to sanction of compassionate allowance as per Regulation 31(1) of the Pension Regulations Act. 2.Though notice served to the respondents, none appeared for the respondents.
3.Considering the limited prayer sought for by the petitioner seeking direction to the respondent for payment of Rs.63,850/- as arrears amount as per Bipartite Settlement and sanction of Compassionate allowance as per Regulation 31(1) of the Pension Regulations Act, the respondents 2 and 3 who are competent authority to pay arrears amount of Rs.63,850/- and sanction of Compassionate allowance respectively, the respondents 2 and 3 are directed to consider the petitioner's representation, dated 5.2.2018 and reminder, dated 15.2.2019 and pass appropriate orders on merit and in accordance with law, as expeditiously as possible, preferably within a period of 8 weeks from the date of receipt of copy of the order. 4.With the above directions, the writ petition stands disposed of. No costs. Connected miscellaneous petition is closed.
