This application has been filed by the 1st and 2nd defendants along with the written statement seeking to set aside the exparte order passed against them on 10.08.2022.

2.It is stated that pending the suit, the 1st plaintiff died and thereafter, steps had been taken to implead the legal representatives. It was only thereafter, the defendants obtained the particulars to file their written statement. The suit had been filed seeking recovery of money on the basis of Joint Venture Agreement and default of the same. 3.Taking into consideration the entire facts, this Application stands allowed. But however, it is stated that, if at all the plaintiffs succeed in the suit and decree is passed, at the time of calculating the interest for payment, one additional percentage for a period of one year should be added while drafting the decree.
