Prayer: Writ Petition filed under Article 226 of the Constitution of India, praying to issue a Writ of Mandamus directing the 1st respondent to consider the representation of the petitioner dated 25.03.2024 and consequently to remove the obstruction made by the respondents by putting up a culvert block on the passage leading to petitioner's land lying in Survey No.253 of Manapathur Village Sendurai Taluk, Ariyalur District within a time frame fixed by this court.

This writ petition has been filed for a direction to the 1st respondent to consider the representation of the petitioner dated 25.03.2024 and for a consequential direction to remove the obstruction made by the respondents by putting up a culvert block on the passage leading to petitioner's land lying in Survey No.253 of Manapathur Village, Sendurai Taluk, Ariyalur District within a time frame fixed by this court.

2. Heard the learned counsel for the petitioner, learned Special Government Pleader appearing for the respondents 1 to 3 and 5 and the learned Government Advocate appearing for the respondents 4 and 6 and perused the materials available on record.
3. It is the case of the writ petitioner that he is the owner of the property situated at Manapattur Village, Sendurai Taluk, Ariyalur District and he was issued with a patta bearing No.4252. During 2015 - 2016, the respondents have laid a road by deviating the original existing road on the patta land comprised in Survey No.342/1 and also put up a culvert block and thereby causing obstruction of about 5 feet wide from out of 12 feet wide passage leading to petitioner's property under the scheme, namely TNRRIS/15-16. That apart, the respondents have made a block covering the width of the passage leading to petitioner's property which led the petitioner to send a series of representation to the District Collector and other officers concerned. As there was no action on the part of the respondents, the petitioner has filed this writ petition.
4. Considering the limited relief sought for in this writ petition, the first respondent is directed to consider the representation of the petitioner dated Page 3/6
25.03.2024, on merits and in accordance with law, taking note of the rights of other third parties also issue notice to other private land owners before passing any orders. Such exercise shall be completed within a period of two months from the date of receipt of a copy of this order.
5. With the above direction, this writ petition is disposed of.
