Respondents Writ petition filed under Article 226 of the Constitution of India praying for the issuance of a writ of mandamus directing the 1st respondent to refer the petitioner's acquisition of Land in [1]S.No.167/1A, 167/2A, 167/2B, 167/3A and 167/4A admeasuring 3885 sq.ft. or 0.02.79 hec, in VMR Nagar, Phase-I, approved layout in Srimangadu village, Sriperumbudur Taluk, Kancheepuram District to the competent court of law for reference under section 18 of the Land Acquisition Act, 1894 within a time limit.

ORDER

Heard the learned counsel for the petitioner and Mr.R.Vijayakumar, learned Additional Government Pleader accepting notice on behalf of the respondents and with their consent, the main writ petition is taken up for final disposal. The petitioner seeks for issuance of a writ of mandamus to direct the 1st respondent to refer the acquisition proceedings of the petitioner's land in question to the competent Court of law for reference under section 18 of the Land Acquisition Act, 1894 within the stipulated time. https://hcservices.ecourts.gov.in/hcservices/

The petitioner has given a representation on 19.03.2002 to refer the petitioner's claim for enhanced compensation in the Civil Court. Though such representation was given in the year 2002, the petitioner has not followed up the matter and has approached this Court only in the year 2015. Therefore, no positive direction can be given in this writ petition. However, it is open to the petitioner to pursue his representation before the 2nd respondent, which shall be considered in accordance with law.

The writ petition is disposed of with the above observation. No costs.
