Civil Revision Petition filed under Article 227 of Constitution of India, to set aside the order dated 05.04.2025 made in I.A.No.789 of 2024 in O.S.No.241 of 2021 on the file of the Learned Principal Subordinate Judge Court, Thindivanam at Villupuram. ORDER

On 19.08.2025, the respondents agreed to file an affidavit of undertaking of the respondents 1 and 2 in the revision and defendants in O.S.No.241 of 2021, that they will abide by the order of injunction, which is in force and would not disturb the possession and enjoyment of the plaintiffs, the matter was adjourned for filing the said affidavit of undertaking.

2. However, today, the affidavit of undertaking is not filed.

3. Admittedly, the interim injunction granted is in force as on date, and therefore, the respondents/defendants are obliged to comply/obey with the said order of the injunction.

4. The learned counsel for the petitioner has already stated that the intention of the petitioner is not to punish the respondents, but only to ensure that the order of injunction as originally granted by the trial Court Page No.2 of 4

and confirmed upto this Court is obeyed in letter and spirit.

5. In view of the above, the Civil Revision Petition is disposed of, directing the Mailam Police Station to take swift action, if any complaint is given by the revision petitioner, alleging wilful disobedience of the interim order already granted in favour of the revision petitioner. No costs.
