ORDER

This revision has been filed, challenging the order dismissing the application under Order XXXVIII Rule 5 of CPC in I.A.No.4 of 2023 by order dated 07.11.2024.

2.As there has been no interim order in the revision petition, I am informed that trial has proceeded with and now the Trial Court has reserved the matter for judgment and the judgment is to be pronounced on 03.09.2025.

3.In the light of the above, I do not find any serious prejudice caused to the revision petitioner in view of the order passed in I.A.No.4 of 2023, dismissing the application seeking attachment before judgment. As the suit is going to be decided shortly, the plaintiff can await the outcome of the suit and subject to result of the suit, he may choose to execute the decree in his favour, if any.

4.In view of the above, the Civil Revision Petition is dismissed. There 2/4

shall be no order as to costs. Connected Civil Miscellaneous Petition is closed.
