Petition praying that in the circumstances stated therein the High Court will be pleased to modify the conditions no 5 & 6 imposed on the petitioner in Crl.O.P.No.8850 of 2016 order dated 26.08.2016 in Crime No.2 of 2013.

Order : This petition coming on for orders upon perusing the petition and upon hearing the arguments of M/S.R.THIRUMOORTHY, Advocate for the petitioner and of MR.R.RAJARATHINAM PUBLIC PROSECUTOR on behalf of the Respondents the court made the following order:- This petition is filed to modify the condition Nos.5 and 6 imposed on the petitioner in Crl.O.P.No.8850 of 2016, by order dated 26.08.2016. Though there is dispute with regard to the Solvency Certificate issued by the Tahsildar and the Sub-Registrar and that the Sub-Registrar has given a certificate that a square feet of the property would fetch Rs.150/- and the total extent of the land is 3125-1/2 Sq.Ft. and that of the Tahsildar to the same extent of land, being valued at Rs.12 lakhs, but however, restricted to Rs.10 lakhs, without prejudice to the rights of the parties who are interested / beneficiaries, as it is one of economic offence, for the purpose of disposal of this petition, the Tahsildar Certificate is taken into account and the petitioner shall deposit cash of Rs.5

lakhs (Rupees five lakhs only) before the Court below to the credit of C.C.No.10 of 2014, on or before 03.04.2017. This petition is ordered accordingly.
