Mrs.Denial Mary CRL.R.C.No.626 of 2014 (This Criminal Revision Petition is filed Under Sections 397 and 401 of CR.P.C praying to set aside the order dated 05.06.2014 passed in C.A.No.97 of 2013 on the file of the I Additional Sessions Court, Chennai modifying the conviction under Section 138 of Negotiable Instruments Act to undergo six months simple imprisonment and to pay compensation of Rs.75,000/- to the complainant under Section (3) Cr.P.C within a period of one month in default to undergo additional one month simple imprisonment dated 06.04.2013 passed in C.C.No.3627 of 2011 on the file of the Fast Track No.III, Metropolitan Magistrate Level, Saidapet, Chennai in to payment of compensation a sum of Rs.75,000/- (cheque amount) to the complainant, in default, to undergo six months simple imprisonment) K.Jayavelu .. G.M.Logamurthy .. Respondent This case came up for settlement before the Lok Adalat. Both the parties are present. The learned counsel for the petitioner Mr.G.Moorthi and the learned counsel for the respondent Mr. K.Vinoth Kumar are present. After mutual discussion, negotiation, mediation and conciliation between both parties, they arrived at a compromise to settle the matter as follows:- TERMS OF SETTLEMENT The revision petitioner who is the accused in C.C.No.3627 of 2011 on the file of the Fast Track Court No.III, Saidapet, Chennai has filed this revision, since, he was convicted by the Trial Court and the conviction was confirmed by the Appellate Court.
2. Revision Petitioner, respondent and their respective counsel are present today. Already they have compromised the matter, thereby, the revision petitioner agreed to pay a sum of Rs.75,000/- (Rupees Seventy Five Thousand only) to the respondent, towards the entire cheque amount. Rs.50,000/- seems to have been deposited by the revision petitioner before the trial Court and this Adalat has passed an order, dated 07.04.2015 that the respondent is directed to withdraw the deposited amount of Rs.50,000/- (Rupees Fifty Thousand only) from the trial Court and a direction has also been given to the trial Court to disburse the amount to the respondent.
3. Today the balance amount of Rs.25,000/- (Rupees Twenty Five Thousand only) has been paid by the revision petitioner and the respondent has received it towards the full and final settlement of the cheque amount.
4. In view of the above settlement, the conviction and sentence passed on the revision petitioner stands set aside and the Criminal Revision Petition stands disposed off as settled. The full Court fee paid shall be refunded to the revision petitioner in the manner provided under Section 69-A of the Tamil Nadu Court-Fees and Suits Valuation Act, 1955 and the Court Fees Act, 1870 as provided for under sub Sec.1 of Section 21 r/w 25 of LSA Act 1987 as amended in 1994.
