ORDER

The writ petition is filed for the relief set out below: "directing the respondent to pay difference in leave salary and difference in gratuity as per 13th wage settlement dated 04.01.2018 with 10 percent interest to the petitioners."

2. The brief facts which has culminated in the filing of these writ petitions are set out below:

2.1. It is the case of the petitioners that they joined the service as "Conductors under the first respondent Corporation. They retired on attaining the age of superannuation. It is the contention of the petitioners that their settlement benefits had been settled in pre-revised pay instead of revised pay. As a consequence of 13th wage revision, the difference in leave salary and gratuity has not been settled. Since the petitioners are entitled to get the difference payments with interest as per 13th wage revision, they made several representations to the respondents to pay their differential payments with interest. However, the same have not been considered to date by the respondents. Hence, the petitioners are before this Court.

3. Heard the learned Counsel on either side and perused the records.

4. Considering the limited request of the petitioners and taking note of the fact that the petitioners' representation has not been considered to date by the respondents, a mandamus, is therefore, issued to the respondents to pay the difference in Leave salary and gratuity as per 13th wage settlement dated

04.01.2018 at the rate of 6% instead of 10% per annum as claimed for within a period of one month from the date of receipt of a copy of this order.

5. Accordingly, this Writ Petition is disposed of. There shall be no order as to costs. Connected miscellaneous petition in W.M.P.No.No.24162 of 2026 is ordered as prayed for.
