ORDER

This petition has been filed seeking to punish the respondent for the willful disobedience of the order dated 03.02.2023 in W.P.No.28219 of 2019.

2.The learned Additional Advocate General had forwarded an order in Na.Ka.No.4494/2021/PE4 dated 11.09.2023 granting reinstatement of the petitioner herein. However, the very basis for the reluctance of the respondent to appoint the petitioner was that there was a serious apprehension on the part of the respondent that the petitioner had produced bogus certificates at the time of appointment. Fraud vitiates any solemn proceedings at any point of time.

3.It is contended by the learned counsel for the petitioner that in the order of the writ petition, there is no specific direction given to conduct an enquiry. However, the right to conduct enquiry, if there is an apprehension that the certificates produced are bogus is inherent on the respondent / employer, who have every right to examine and verify the certificates produced by the petitioner at the time of appointment.

4.That liberty is granted to the respondent. The petitioner had been reinstated, but he will necessarily have to face the disciplinary proceedings to find out the truth behind the certificates produced by him. 5.Recording as above, this contempt petition stands closed. 11.09.2023 smv Neutral Citiation : Yes / No Index : Yes / No C.V.
