PRAYER: Writ Petition filed under Article 226 of Constitution of India, praying for issuance of Writ of Mandamus directing the third respondent not to grant approval for any work over the petitioner land situated at Mottur Village, Gudiyattam Taluk, comprised in Survey.No.242/2 and 251/1, till the pending disposal of the petitioner's representation dated 04.01.2025. Seeking directions to the 3rd respondent not to grant approval for any work over the petitioner's land situate at Mottur Village, Gudiyattam Taluk, comprised in Survey.No.242/2 and 251/1, by considering the petitioners' representation dated 04.01.2025, the present writ petition is filed.
2. Mr.R.Murthi, learned Government Advocate takes notice for the respondents.
3. By consent of both the counsels, this writ petition is taken up for final disposal at the admission stage itself. Page No.2 of 6
4. The petitioner is the owner of the property comprised in S.No.242/2 and 251/1 situated at Mottur Village. While so, in the year 2002, the ex-panchayat president, Rajamanikkam and one Sampath, who are adjacent owner's of the petitioner, planned to create a pathway in the petitioner's lands for entry to their plots. Later, the 3rd respondent started troubling the petitioner by claiming that his lands belonged to the Government. Therefore, the petitioner submitted a representation on 04.01.2025 to the concerned authorities. The petitioenr states that the first respondent in pursuance of the petitioner's representation directed the third respondent to take appropriate action, but till date, no action was taken. As the third respondent was taking steps to grant approval for laying the road in petitioner's land, the petitioner left with no remedy filed the above writ petition.
5. Though many grounds have been raised in this writ petition, learned counsel for the petitioner submitted that, it would suffice if, this Court issues a direction to the third respondent, not to grant approval for any work over the Page No.3 of 6
petitioner's land, till the petitioner's representation dated 04.01.2025, which is pending, is disposed of.

In view of the above facts and considering the limited relief sought for by the learned counsel for the petitioner, without going into the merits of the case, I direct the third respondent to consider the petitioner's representation dated 04.01.2025, and pass orders on merits and in accordance with law, within a period of eight(8) weeks from the date of receipt of a copy of this order and till then not to grant approval for any work over the petitioner's land.
7. With the aforesaid direction, this writ petition is disposed of. No costs.
