ORDER : The Court Made the following order :- The petitioner who was arrested and remanded to judicial custody on 05.08.2021 for the offence under Sections 419, 460, 471 of I.P.C. r/w. Section 34 of I.P.C. and Section 420 r/w.511 of I.P.C. in Cr.No.144 of 2021 on the file of the respondent police, seeks bail. 2.It is the case of the prosecution that the petitioner is alleged to have facilitated the other accused to encumber the defacto complainant's property. However, the said act was suspected by the Sub Registrar Office and thereafter the complaint came to be lodged by the defacto complainant.
3.The learned Senior Counsel appearing for the petitioner would submit that the petitioner has not committed any offence as alleged by the prosecution. He would further submit that the petitioner's name was not found in the F.I.R. and that the allegation against the petitioner is that he facilitated the other accused to encumber the property owned by the defacto complainant and would further submit that the document was not registered and only attempt was made. https://hcservices.ecourts.gov.in/hcservices/
4.The learned Public Prosecutor (Pondicherry) would submit that the petitioner is a habitual offender and there are three previous cases as against the petitioner and investigation is still pending and vehemently opposed for grant of bail to the petitioner. 5.Considering the fact that the petitioner is a habitual offender and there are three previous cases as against the petitioner, this Court is not inclined to grant bail to the petitioner. 6.Accordingly, this criminal original petition is dismissed. -sd/- 25/08/2021 This order, on being produced, be punctually observed and carried into execution by all concerned TRUE COPY Sub-Assistant Registrar (Statistics/C.S.)
