O R D E R
This writ petition has been filed by the petitioner for issuance of a Writ of Mandamus directing the 1st respondent to dispose of the petitioner's appeal dated 17.10.2016, followed by reminder dated 25.09.2017 filed against the order dated 21.03.2014 passed by the 3rd respondent within a stipulated time. 2.Heard Mr.M.V.Venkataseshan, learned counsel for the petitioner and Ms.Karthika Ashok, learned Standing Counsel for the respondents.
3.With consent, this writ petition is taken up for final disposal.
4.It is the case of the petitioner that while he was working as a Tax Collector, he was issued with a charge memo dated 21.03.2014, by the 3rd respondent, as the petitioner failed to collect the targeted amount of tax and he was absent for the meeting, imposing punishment of stoppage of increment for five years with cumulative effects. Thereafter, the petitioner was retired from service on 31.03.2014. Only after retirement, the petitioner preferred appeal in the year 2016 before the 1st respondent challenging the said punishment. Till date, the appeal has not been disposed of. Hence, the present writ petition.
5.The learned counsel appearing for the petitioner would submit that it would suffice, if this Court issues direction to the 1st respondent to consider the petitioner's appeal dated 17.10.2016, within a stipulated time frame.
6.Considering the limited prayer sought for by the petitioner and without going into the merits of the case, this Court directs the 1st respondent to consider the petitioner's appeal dated 17.10.2016, and pass orders on merits and in accordance with law, within a period of twelve weeks' from the date of receipt of a copy of this order.
7.With the above direction, this writ petition is disposed of. No costs.
